Important: All support queries and claims are managed by a customer care centre available on 087 940 3151/2. Due to the centralized nature of the customer care centre, there is no mechanism to return faulty items to the original point of purchase.
12 MONTHS WARRANTY
The warranty covers the Nintendo DS Lite, any other DS hardware products or accessories (“Product”) supplied by Core Gaming Systems (Pty) Ltd (“CGS”).
Subject to the terms and exclusions below, CGS warrants to the original consumer purchasing this product that, for a period of twelve (12) months from the date of the original purchase by a consumer, this product is free from defects in material and workmanship at the time of such purchase.
To make a valid claim under this warranty, the original purchaser must notify CGS of any defect in this product within twelve (12) months from the date of original purchase and must return this product to CGS within thirty (30) day of notifying CGS of any such defect.
If, having inspected this product, CGS accepts that this product was defective at the time of the original purchase, CGS will (in its sole discretion) either repair or replace the defective part or the product itself without charge.
This warranty does not affect any statutory rights which the purchaser of consumer goods may have.
EXCLUSIONS
This warranty is not valid if:
- the Product is purchased outside South Africa;
- the Product was purchased within South Africa before 1 February 2008;
- the Product has been subjected to misuse, abuse, accident or want of care including liquid/moisture damage, breakage, wear and tear, unreasonable use, modifi cation, inappropriate repair, use with products not sold or licensed by Nintendo (including, but not limited to, non-license game enhancements, copier devices, adaptors or power supplies).
- the Product has been modifi ed and/or tampered with;
- the Product fails due to causes unrelated to defective materials, workmanship or manufacturing;
- the Product is not used at all times in accordance with the Offi cial Operations Manual or other documentation provided by Nintendo; and
- the Product is ex-rental or second-hand products or products that are or have been used for commercial purposes.
OTHER EXCLUSIONS
- Accessories, peripherals or other items that are intended for use with the Product but are not manufactured for or by Nintendo (whether or not included with the product at the time of purchase);
- Gradual decrease over time in the capacity and performance of the Nintendo DS Lite Lithium Ion Rechargeable Battery Pak (USG-003) (which, for the avoidance of doubt, will not be deemed to be a defect in material or workmanship of this product);
- Data loss is not covered by this warranty;
- Software (other than the DS Lite Operating Software) or games (whether or not included with the Product at the time of purchase) are not covered by this warranty.
HOW TO MAKE A CLAIM
Before sending the Product to the Nintendo Service Centre, you should remove or delete any private or confi dential fi les or data. You accept and agree that Nintendo will not be responsible for any loss, deletion or corruption of your fi les or data that have not been deleted or removed. CGS strongly recommends that you make a backup copy of any data that you do not remove or delete. When sending the product to the Nintendo Service Centre, please:
- Use the original packaging where possible;
- Provide a description of the defect;
- Attach a copy of your proof of purchase, ensuring that it contains the date of purchase of this product;
- Ensure that a service reference number (receive from the Nintendo Service Centre) is clearly marked on the documentation.
If the above twelve (12) month warranty period has expired at the time the defect is discovered or if the defect is not covered by this warranty, CGS may still be prepared to repair or replace the part causing the defect or the product itself (at its sole discretion). DS LITE OPERATING SOFTWARE
The DS Lite Operating Software may only be used with the Product and may not be used for any other purpose. You must not copy, adapt, reverse engineer, decompile, disassemble or modify the DS Lite Operating Software other than as expressly permitted by applicable law. Nintendo may use anti-copying or other measures to protect its rights in the DS Lite Operating Software.
