Club Nintendo Terms and Conditions
Last updated:04.04.2011Club Nintendo is operated by Nintendo of Europe GmbH, a company based at Nintendo Center, 63760 , Germany. In these Terms and Conditions, Nintendo of Europe GmbH will be referred to as “Nintendo”, “we” or “us”.
If you register as a member of Club Nintendo, you agree to be bound by, and to comply with, these Terms and Conditions and the Club Nintendo Privacy Policy.
These Terms and Conditions are applicable to Club Nintendo for residents of South Africa at http://www.nintendo.co.za.
1. Registration as a member of Club Nintendo

1.1 Requirements for the registration
In order to register as a member of Club Nintendo, you must be a resident of South Africa. If you are not a resident of South Africa, please use the “Language” button to go to the Club Nintendo website of your country of residence. You will not be able to log in to the Club Nintendo website of any other country after registration. You should therefore choose your country carefully when registering.
This also means that:

You can redeem your Stars for Stars Catalogue items only from the Club Nintendo you registered with.

When you enter a Club Nintendo PIN number, you should ensure that you are logged in to your country's Club Nintendo website, or else you risk losing the Stars you would get for registering your product.
For the registration, you must submit your date of birth, email address, country, postcode, and gender, as well as a username and password for use in Club Nintendo.
If you are under 16 years old, you must have permission from a parent or guardian when registering.
1.2 Protecting your information
Nintendo will not disclose the data you provided us with to unauthorised third parties. If you ask Nintendo to grant you access to your account because you have forgotten your password and your email address is no longer active, we will not be able to do so unless you can actually prove that it is your account. This proof is often very difficult to provide, so in many cases Nintendo cannot grant access. Therefore, it is of utmost importance that you safely store your password and that if you change your email address, you change your registration profile at the same time.
If you register for Club Nintendo, we may collect certain personal information about you. To learn more about how we use your information, and how we look after it, please read the Club Nintendo Privacy Policy.
We reserve the right to terminate the account of and/or take action against anyone who supplies false information when registering, impersonates other users or uses an account that is not their own.

2. Stars

2.1 How do you earn Stars
If you are a member of Club Nintendo, you can earn Stars while interacting with Nintendo. Stars may be earned by registering products and filling out product surveys. The activities by which Stars can be earned may change with future effect both in character and with respect to how many Stars will be allotted for them. The registration of a product requires that the respective product has been lawfully purchased. Nintendo reserves the right to cancel registrations if this requirement is not fulfilled.
2.2 How you can check your current account status
You can check the current status of your account, including your earned Stars, by clicking on the appropriate button as indicated on the Club Nintendo website.

2.3 How Stars can be redeemed
The Stars you have earned can be redeemed for premiums in accordance with the Stars Catalogue valid at the time of redemption.

2.4 Number of Stars and expiration of Stars
The maximum number of Stars you can earn in total may be limited by Nintendo with a notice period of one week. This does not apply to Stars you have already earned at the moment of notice.
Stars expire 24 months after they have been earned, so unredeemed Stars which are older than 24 months will be deleted from your account.
3. Premiums

3.1 Star Catalogue and Premiums
The Stars Catalogue of Club Nintendo lists the items for which the Stars you have earned in Club Nintendo can be redeemed. Additionally, Nintendo may offer free giveaways to Club Nintendo members from time to time. In these Terms and Conditions, any physical or downloadable items in the Star Catalogue and free giveaways are referred to as “Premiums”.
The Premiums in the Stars Catalogue do not constitute a concrete offer but a mere indication which items are (or were) generally available. Nintendo reserves the right to change the Premiums in the Stars Catalogue at any time without prior notice. In case the number of Stars necessary to redeem a particular Premium has increased due to a change in the Stars Catalogue, you are entitled within one week after the change of the Stars Catalogue to redeem such Premiums for the number of Stars that was indicated in the Stars Catalogue before the change by sending an email to Nintendo customer service. However, many Premiums in the Stars Catalogue are only available for a limited time or in a limited number. There is no obligation for Nintendo to make available such Premiums beyond those limitations. Limited Premiums will be allocated on a first come, first served basis.
In addition, Nintendo reserves the right to replace or withdraw Premiums in the Stars Catalogue. In the event that Premiums set out in the Stars Catalogue consist of products supplied by third parties, Nintendo reserves the right not to deliver the Premiums against reimbursement of the redeemed Stars in the event that Nintendo itself has not been supplied by its supplier.
In the event that Nintendo becomes aware of any defect in a Premium, it shall be entitled to withdraw the Premium without further notice from the Stars Catalogue.
Nintendo will only ship physical Premiums of the Stars Catalogue to addresses in South Africa.

3.2 Special licence terms for Software
If you receive as Premiums any digital online assets and/or software (hereinafter referred to as "Software"), the following licence terms apply:
Nintendo grants to you free of charge and free of any fees the right to use the Software, which is neither freeware nor public domain software.
You shall be entitled to install and apply the Software for private use and for use on a single computer system only.
You may not install, use and/or apply the Software on any form of computer network whatsoever. You may not transfer the utilisation rights or the Software itself, whether in whole or in part, to any other person or hire or lend out the Software except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. You shall not be entitled to amend, further develop, decompile or convert the Software except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

3.3 Special Terms for Mobile Assets
If you receive as Premiums any content for your mobile phone (hereinafter referred to as "Mobile Assets"), the following terms apply:
Mobile Assets can only be downloaded for private use onto one mobile phone per user. If you change to a different model or make of mobile phone, you may not be able to download Mobile Assets onto the new mobile phone.
Wallpapers and animated wallpapers can only be sent to mobile phones with a colour display, WAP access and WAP Push activated.
Ringtones can only be sent to mobile phones with WAP access, Realtone support and WAP Push activated.
Mobile Assets are subject to copyright protection law and trademark protection law. You shall not be entitled to amend, further develop, decompile or convert Mobile Assets except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

3.4 Liability for Premiums
The Premiums are delivered to you free of charge and on an “as-is” basis. In particular, Nintendo does not warrant any specific features of the Premiums or that they are fit for a specific purpose. Any statements about the Premiums are of a purely descriptive nature and create no legal obligations. The same also applies to statements made or given by third parties in respect of the Premiums. By registering for Club Nintendo, you accept that the Premiums are not of a specific quality standard.
4. Intellectual property rights
All content on the Club Nintendo website, including articles, artwork, screenshots, graphics, logos, digital downloads and other files, is the property of Nintendo, unless owned by a third party and licensed to Nintendo, and is protected by international copyright, trademark and other intellectual property laws. Trademarks and copyrights for third-party games and characters are owned by the companies that market or license those products. Such content may not be used on any other website, in any publications, in public performances, in connection with any product or service that is not Nintendo's, in any manner that is likely to cause confusion among customers, in any manner that disparages or discredits Nintendo, or in any manner that is otherwise exploitative for any commercial purpose or that otherwise infringes Nintendo's intellectual property rights.
5. Misuse of Club Nintendo
You are not allowed to:

register more than once as a member of Club Nintendo;

supply false information when registering;

register the same Nintendo product more than once, unless expressly permitted;

register a product which has not been lawfully purchased;

make use of Stars in any other way than for your personal use only; in particular, it is prohibited to sell or buy Stars or to transfer Stars to another person;

use or promote illicit technical aids in order to earn Stars, e.g. to create, offer, distribute or use software programs or other means that create an automatic online interaction with Nintendo or that create Club Nintendo PINs.
In case there is evidence and/or prima facie evidence that you do not or did not comply with any of the rules above, that you breach any of these Terms and Conditions or that you misuse Club Nintendo in any other way, Nintendo is entitled to refuse the redemption of Stars and to delete your account, including the Stars you have earned. In case of minor breaches, Nintendo will provide you with a prior warning of your non-compliance prior to deleting your account. However, Nintendo is not required to provide you with such prior warning in case of major breaches. A major breach corresponds to serious violations of important provisions of these Terms and Conditions. Important provisions include, but are not limited to, the rules listed above.
6. Termination of Club Nintendo
Nintendo expressly reserves the right to terminate Club Nintendo at any time without prior notice. You will be informed about the termination on the Club Nintendo website and, at the discretion of Nintendo, also via email. In the event of such termination, Nintendo will set a fixed time limit of a least 4 weeks within which Stars that have already been credited to you at the time of termination may be redeemed in accordance with the Stars Catalogue valid at the time of redemption. After the set time limit has expired, your account and all Stars registered to it will be deleted.
You may terminate your account any time by sending an email to nintendo@core.co.za If you terminate your account, your account and all Stars registered to it will be deleted.
7. Changes to these Terms and Conditions
A current version of these Terms and Conditions will always be available on the Club Nintendo website, identified at the top of the page by its effective date. Nintendo may change these Terms and Conditions at any time so far as is necessary or helpful to enhance the service or to adapt it to reflect changes in technical or legal requirements. If we make changes, we will provide a prominent notice about it on the on the Club Nintendo website and also via email. If you do not object to these changes within 4 weeks after they have been communicated to you, the changes will be deemed to be accepted. With the notification, Nintendo will remind you that the changes will be deemed to be accepted if you do not object to these changes within 4 weeks after the notification. Should you object to the changes, it may lead to a termination of your Club Nintendo account upon a reasonable notice.
8. Exclusion of Liability
Nothing in these Terms and Conditions limits or excludes Nintendo's liability for death or personal injury caused by its negligence, for fraud, or for any other liability the limitation or exclusion of which is not permitted by law. Other than as expressly set out in these Terms and Conditions, Nintendo does not give or make any representations, warranties, conditions or other terms about Club Nintendo (collectively, "Promises"), and excludes any and all implied Promises (whether implied by common law, statute or otherwise) to the fullest extent permitted by law. You acknowledge that you have not entered into these Terms and Conditions in reliance on any prior express or implied representation made by Nintendo (whether made innocently or negligently) and that the terms of this Agreement set out the entire agreement and understanding between Nintendo and you in respect of Club Nintendo. In the event that Nintendo breaches the terms of this Agreement, we will be liable to you for loss or harm that you suffer that was a reasonably foreseeable consequence of our breach (and you must take reasonable measures to mitigate any such loss or harm that you may suffer). However, Nintendo excludes any and all liability for indirect, special or consequential losses (such as loss of profits, loss of revenue, loss of goodwill, loss of opportunity, loss of data or otherwise).
9. Applicable law
The laws of South Africa shall apply to these Terms and Conditions to the exclusion of the UN Sales Convention on Contracts for the International Sale of Goods.
